Himachal Pradesh Govt. promulgates Industrial Disputes (Himachal Pradesh Amendment) Ordinance, 2020 ; conditions of strikes/lock-outs now extends to non-public utility services as well

In a recent Ordinance dated 9th July, 2020, the Governor of Himachal Pradesh has promulgated the Industrial Disputes (Himachal Pradesh Amendment) Ordinance, 2020 (Ordinance) bringing about amendments to the Industrial Disputes Act, 1947 in its application to the State.

The Ordinance contains the following key provisions:

Strikes and lock-outs: Now, the conditions of strikes and lock-outs also extend to persons employed as well as employers of non-public utility services as well in addition to employees / employers of public utility services.

Conditions precedent to retrenchment of workmen: With this Ordinance, at the time of retrenchment, the workman have to be paid compensation equivalent to 60 days (increased from 15 days) average pay for every completed year of continuous service or any part thereof in excess of six months.

 Special provisions, relating to lay-off, retrenchment and closure provided in Section 25 K: The special provisions, relating to lay-off, retrenchment and closure are now applicable to industrial establishments employing not less than two hundred workmen (increased from 100) on an average per working day in the preceding year.
